These Terms of Service ("Terms") govern your access to and use of the Volmeris commerce platform and website (the "Service") operated by Volmeris, Inc. ("Volmeris", "we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms.
1. Description of Service
Volmeris provides a multi-tenant commerce platform that enables operators to launch, manage, and scale online storefronts. The Service includes storefront hosting, payment processing integrations, product management, fulfillment tools, and related features as described on our website.
2. Account registration
To use the Service you must create an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorised use.
3. Acceptable use
You agree not to use the Service to:
- Violate any applicable law or regulation.
- Infringe on the intellectual property rights of others.
- Distribute malware, spam, or fraudulent content.
- Sell prohibited or restricted goods as defined by our Acceptable Use Policy.
- Attempt to gain unauthorised access to the Service or its related systems.
We reserve the right to suspend or terminate accounts that violate these terms.
4. Payment terms
Paid plans are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law or as expressly stated in our refund policy. We may change pricing with 30 days' notice. Continued use of the Service after a price change constitutes acceptance of the new pricing.
5. Intellectual property
The Service, including its original content, features, and functionality, is owned by Volmeris and protected by copyright, trademark, and other intellectual property laws. You retain ownership of the content you create and upload through the Service.
6. Data and privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.
7. Availability and support
We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may perform scheduled maintenance with reasonable advance notice. Support is provided according to the terms of your subscription plan.
8. Termination
You may close your account at any time through your operator dashboard. We may suspend or terminate your access if you breach these Terms. Upon termination, your right to use the Service ceases immediately. We will make your data available for export for 30 days following account closure.
9. Limitation of liability
To the maximum extent permitted by law, Volmeris shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.
10. Disclaimer of warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
11. Governing law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Volmeris is incorporated, without regard to conflict of law principles.
12. Changes to these terms
We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on this page and updating the effective date. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
